Contest Official Rules

NO PURCHASE NECESSARY. VOID WHERE PROHIBITED

HOW TO ENTER: You must be 21 years of age or older and a legal resident of the United States or Canada. Contest begins on December 1, 2005, and ends on 11:59 p.m., February 5, 2006. Visit michigan.org/motownwinterblast and complete the online entry form by providing your name, complete address, phone number and valid email address (limit one online entry per person and per email address). One individual package will be awarded to one prize winner. The winner will be chosen by random drawing on or about February 6, 2006.   

WINNERS: The Winner will be selected in a random drawing from eligible entries received. Odds of winning depend on the number of eligible entries received. Prize winners will be notified by certified mail. The Winner and travel guests will be required to sign and return an Affidavit of Eligibility (stating the winner will assume all tax liability) and Release of Liability/Publicity where permitted, before prize is awarded, along with a legible photocopy of photo I.D. and Social Security Card. The Winner and travel guests will be required to return said documents/affidavits within ten (10) days from the postmark date on the prize notification letter. Failure to comply with this requirement or return of prize notification as undeliverable will result in forfeiture of prize. Unclaimed or returned prizes will not be awarded. The Prize is non-transferable and cannot be substituted, except that Sponsor reserves the right in its sole discretion to substitute the prize with a prize of equal or greater value if prize cannot be awarded as stated. Winner shall forfeit any prize not accepted in its entirety. No responsibility is assumed for technical failure of any kind or for lost, late, damaged, misdirected, incomplete, altered, illegible or postage due for qualification documents or mail.

Entrants agree that Travel Michigan has the sole right to decide all matters and disputes related to the contest and that Travel Michigan's determination is final and binding. The Winner agrees to allow use of their name, photograph, voice and likeness in any medium of communication, including print, Internet, radio and/or television for advertising, promotional or other purposes by Travel Michigan and/or its affiliates or sponsors, without additional compensation. Winner assumes all applicable tax liability for the contest prizes. Winner must claim prize within seven (7) days of notification; failure to do so will result in forfeiture of prize. 

PRIZE: Prizes are non-transferable, non-negotiable and not redeemable for cash.  One (1) winner will receive five (5) night/six (6) day lift and lodging package at Boyne Mountain's all-new Mountain Grand Lodge and Spa for four people and use of a Hertz rental car for 10 days.  Package includes five night's accommodations for four (two queen beds), four lift tickets for six days, two-hour group ski lesson for four and two days of Avalanche Bay Indoor Water park admission for four. Winner and up to one additional driver will be permitted to operate the rental vehicle.  Winner and additional driver must be at least 21 years of age and show proof of a valid driver's license from a jurisdiction acceptable to Hertz and meet Hertz standard qualifications in effect at the time and place of rental for renting or operating Hertz vehicles..  The winner must elect the optional Loss Damage Waiver when completing the Rental Agreement.  The optional Loss Damage Waiver fee is part of the prize package and will not be the responsibility of the winner.  The winner may select either the Ford Explorer or Mercury Mountaineer as the rental vehicle.  Prize is limited to the cost of the rental vehicle for one rental period not to exceed ten calendar days, the optional Loss Damage Waiver, and the fee for one additional driver.  The cost of fuel and/or any other expense associated with operating the rental vehicle is the sole responsibility of the winner.  The prize package is valid through December 21, 2006. Estimated value of total package is $2,500.00.

Winner is responsible for all travel not identified, meals, and incidental charges, including telephone calls, valet service, gratuities, merchandise, room service and all applicable taxes. If any prize becomes unavailable, Travel Michigan reserves the right to substitute a prize of comparable value.     

ELIGIBILITY: This contest is not open to employees of Travel Michigan, Michigan Economic Development Corporation, Boyne Mountain, Avalanche Bay  or to employees or immediate family of any Travel Michigan, Michigan Economic Development Corporation, Boyne Mountain, Avalanche Bay,  parent, subsidiary or affiliated company, licensee, advertising or promotional agency, or sponsor. Void where prohibited or restricted by law. Travel Michigan reserves the right to reject entries from countries, states and jurisdictions where this contest is prohibited.  

GENERAL TERMS AND CONDITIONS: By participating, entrants agree that the Sponsor, its agents and representatives, affiliates, subsidiaries and legal advisors are not responsible or liable for, and shall be released and held harmless from: (i) telephone, electronic, hardware or software program, network, Internet, or computer malfunctions, failures, or difficulties of any kind; (ii) any condition caused by events beyond the control of Sponsor that may cause the Contest to be disrupted or corrupted; (iii) any printing or typographical errors in any materials associated with the Contest; (iv) any and all losses, damages, rights, claims and actions of any kind in connection with or resulting from participation in the Contest, acceptance, possession, or use of any prize, including without limitation, personal injury, death, and property damage, and claims based on publicity rights, defamation, or invasion of privacy. Sponsor reserves the right, in its sole discretion, to suspend or cancel Contest at any time if a computer virus, bug, or other technical problem corrupts the administration, security, or proper conduct of the Contest. By entering in to the contest, entrants grant permission to allow the Sponsor to share submitted information with co-sponsors and prize providers that the Sponsor selects. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of participant and Sponsor in connection with contest, shall be governed by, and construed in accordance with the laws of the State of Michigan, without giving effect to any choice of law or conflict of law rules or provisions (whether of the State of Michigan or any other jurisdiction), that would cause the application of the laws of any jurisdiction other than the State of Michigan.
